Litigation funding is the, non-recourse funding of legal costs, lawsuits, claims, awards, litigation, defaults or arbitrations arising out of a dispute relating to any contract, agreement, tort, statute or treaty, in any part of the world and at any stage of the legal process.

Put simply, investors provide funds ( lawsuit advances) to a claimant, defendant, litigant or attorney in cases where there is a monetary value on the claim, and pay for the legal costs incurred and in return, the investor will require a fee or part of the settlement. No WIN – No Fee!

Recourse : The investors, provide funds on a Non-Recourse basis. This means that if the claimant’s case fails, the investor carries this cost. Why would they do this ? If you win your case, the lender investor will be entitled to a portion of the claim or a fee that is negotiated and agreed to, before advancing lawsuit funding.

The funding of legal costs of litigation by a third party ( investor), in a legal claim, judgment or award in return for a share of the settlement proceeds of the claim, if the claim is successful. If the claim is not successful, the claimant does not have to pay the legal fees back. The investment is provided on a ‘NO WIN – NO FEE’ basis.

  5. Positive responses are sent you direct and then you enter into negotiations with the third party funders for structured settlement funding and legal costs bridging finance.
  6. If a cash advance on lawsuits is secured between you and the litigation fund, to finance legal costs, then we are paid a facilitation fee.

All the legal costs that are agreed to be paid by the litigation funding company are paid on a monthly basis to your appointed attorneys, advocates, lawyers legal council, or as agreed to by all parties to the agreement.

If you win your case, then all the legal costs are paid back to the funder first and then the proceeds of the court award are paid out as per the agreement between the client and the investor / litigation funding company.
